I. General Terms and Conditions
§ 1 Basic Provisions (1) These terms and conditions apply to contracts concluded with us (Gastro Oma München GmbH) via the website www.gastrooma.eu, unless otherwise agreed. The use of your own terms is excluded unless otherwise agreed.
(2) A consumer is any natural person entering into a transaction for purposes that cannot be predominantly attributed to their commercial or self-employed activity. An entrepreneur is any natural or legal person or legal partnership acting in the exercise of their professional or commercial activities.
§ 2 Formation of the Contract (1) The object of the contract is the sale of goods.
(2) By placing products on our website, we make a binding offer to conclude a contract under the conditions stated in the product description.
(3) The contract is concluded via the online shopping cart system: - Add the desired goods to the shopping cart. - Navigate to the cart to review or modify its contents. - Proceed to checkout, provide your details, and confirm the order. - By submitting the order, you accept our offer, and the contract is concluded.
(4) Order processing takes place via email. Ensure your email address is correct.
§ 3 Right of Retention, Retention of Title (1) The right of retention applies only to claims from the same contractual relationship.
(2) The goods remain our property until full payment.
(3) For entrepreneurs: - We retain ownership until full settlement of all claims. - Entrepreneurs may resell goods in the ordinary course of business, assigning claims to us.
§ 4 Warranty (1) Legal warranty rights apply.
(2) Consumers should inspect goods upon delivery. This does not affect statutory rights.
(3) For entrepreneurs, the warranty period is one year.
§ 5 Applicable Law (1) German law applies. For consumers, this applies with mandatory protection laws of their residence country.
(2) UN sales law does not apply.
